DTI ANNOUNCES POSTPONEMENT OF THE EFFECTIVE DATE OF THE CONSUMER
PROTECTION ACT UNTIL 31 MARCH 2011
Please note that the Minister of Trade and Industry has announced that, in terms of items
2 (3) (a) of Schedule 2 to the Consumer Protection Act, he has deferred the general
effective date of the Consumer Protection Act until 31 March 2011, on the ground that
"additional time is required for adequate preparation of the administrative systems
necessary to ensure the efficient and effective implementation." See attached notice.
The Consumer Protection Act, which was due to come into effect on 24 October 2009, will therefore only come into effect
some five months later.
In addition, the Department of Trade and Industry has yet to publish the draft Regulations to the Consumer Protection Act,
for 30 days public comment.
The good news is that industry now has additional time to prepare properly from a
compliance perspective and more importantly to thoroughly train employees (particularly those that interact with the
consumer) to be fully au fait with the requirements of the CPA.
